Booking Conditions This is where your journey begins! Please read these Booking Conditions carefully. They set out your agreement with Peregrine Tours Ltd, trading as Peregrine, and contain important information. Peregrine Tours Ltd is the selling agent for Peregrine Adventures Pty Ltd, trading as Peregrine Adventures with their head office in Melbourne Australia. The Antarctica and Arctic trips described in this brochure are operated by Supernova Expeditions Ltd and Peregrine Shipping Pty Ltd, trading as Quark Expeditions Inc, for which Peregrine Adventures is a selling agent. For Antarctica and the Arctic expeditions the Booking Form is submitted to Quark Expeditions Inc subject to the terms and conditions of the Supernova Expeditions Cruise Contract or the Peregrine Shipping Passage Ticket, the terms of which are incorporated into and form part of these Booking Conditions. Peregrine will not accept the Booking Form nor issue your Cruise Contract or Passage Ticket until you have established to Peregrine that you have obtained appropriate travel insurance. All holidays in this brochure, except as expressed otherwise above, are operated by or through Peregrine Tours Ltd (hereinafter called Peregrine or we), Peregrine Tours Ltd, Supernova Expeditions Ltd and Peregrine Shipping Pty Ltd are members of the TUI Travel PLC Group of Companies. Registered in England & Wales No: 6072876 and are sold subject to the following conditions: By signing the Booking Form and paying the non-refundable deposit you acknowledge you have read and agreed to these Booking Conditions. The Booking Conditions are binding when your booking is confirmed in writing to you or your travel agent. 1) TO MAKE A BOOKING You must send Peregrine a signed, fully completed Booking Form and a non-refundable deposit of £500 Antarctica and High Arctic, £150 for all other trips and £100 for extensions. We will invoice you for the remainder of the cost, which you must pay not later than 56 days (90 days for Antarctica and the High Arctic) before departure. If you book less than 56 days (90 days for Antarctica and the High Arctic) before departure, full payment must be made on booking. If you book by phone and pay by credit card a fully completed Booking Form must be received by Peregrine within three days of payment. Acceptance of your booking will be confirmed in writing to you or your travel agent and a contract comes into existence on the date shown on that letter or email. Payment for all monies due, including any surcharge, must be paid to us no later than 56 days (90 days for Antarctica and the High Arctic) before tour departure. If you do not pay the balance by the due date your booking will be cancelled and you will forfeit your deposit 2) NOT INCLUDED IN THE TOUR PRICE Airfares, visas and passport fees, airport taxes, additional hotel accommodation, laundry, postage, drinks, medical expenses, travel insurance, telephone calls, gratuities to staff and crew. 3) YOUR TOUR Peregrine operates trips in regions where standards of accommodation, transport, safety, hygiene, medical facilities and other infrastructure may, at times, be lower than those you normally expect. Please bear this in mind when making your booking. Travelling with Peregrine requires a certain measure of flexibility, good humour, and an understanding that the itinerary, accommodation and modes of transport may be changed without notice due to circumstances beyond Peregrine control. By signing the Booking Form you agree to Peregrine making necessary changes without liability. All Peregrine tours, but especially those in remote or unstable regions, or regions with dangerous wildlife, involve a risk of injury, psychological trauma, disease, loss or damage to property, inconvenience and discomfort. By signing the Booking Form you agree to assume all risks associated with the journey to the maximum extent permitted by law. When assessing whether tours will operate, Peregrine uses information from its local offices in conjunction with advice from the British Foreign Office, the Australian Department of Foreign Affairs and Trade, and the US Department of State. It is your responsibility to acquaint yourself with the travel advice provided by these government bodies. By signing the Booking Form you acknowledge your decision to travel on a Peregrine tour is made after due consideration of relevant travel information that may be made available at any time and you agree to assume the risks associated with the tour. Whilst we are able to provide basic advice to clients regarding passports and visa requirements, you should check with the appropriate Embassy, Consulate or British Foreign Office for the exact requirements for your chosen tour and date of travel. It is your responsibility to ensure that you have the correct passport and visas to gain access to any country/region included in the travel arrangements which you purchase from us. If you fail to do so, we have no liability to you for any cost, loss or damage which you suffer, nor will we refund you the cost of any unused portion of your travel arrangements. In some cases, countries will refuse entry to clients who have criminal records. Should you be concerned about this, please check with the embassy or consulate of the countries to which you are traveling. 4) PEREGRINES RESPONSIBILITIES Peregrine is responsible to you for the proper performance of our obligations under the contract whether those obligations are provided directly by us, or by third-party service providers engaged by us and acting within the proper course of their employment we will provide these services with reasonable skill and care. We are liable to you for any damage caused to you by our failure to perform the contract or by our improper performance of the contract, unless that failure is a) attributable to you; b) attributable to a third party unconnected with the provision of services to you; c) due to unusual and unforeseeable circumstances beyond Peregrines control that could not have been avoided even if all due care had been taken; TRAVEL INSURANCE It is a condition of joining any of our holidays that you must be insured against medical and personal accident risks (to include repatriation costs, air ambulance and helicopter rescue services). We also strongly recommend that you take out cancellation insurance. Our insurance policy is designed specifically to cover the potential risks on our holidays, and you should be aware that some policies do not include, or restrict, cover for this type of travel. If you do not take our policy, you must ensure that the policy you do take provides an equivalent level of protection and covers you for the activities involved. You must carry proof of insurance (e.g. your insurance certificate) with you on the holiday; if you cannot provide this at the start of the holiday, you will be required to take out a suitable policy at that time. If this is not done or impossible for practical reasons, then you will not be allowed to continue with your trip and will not be entitled to any refund for services not provided. Important There are many cheaper Insurance policies available on the market, but before buying any policy we strongly advise that you check fully what will and wont be covered. In particular, the cover provided by credit cards is often very restricted. SUMMARY OF COVER Medical Expenses up to £5,000,000 Medical and additional expenses incurred abroad (including emergency d) due to an event which even with all due care Peregrine could not foresee or forestall. Peregrine will not accept responsibility or liability for any passenger who contravenes any law or regulation of any country visited. Where Peregrine is found liable for damages for failing to carry out the contract, the maximum amount of such damages, for compensation and loss of enjoyment will be limited to three times the basic trip price shown on the invoice. Where the damages relate to the provision of transport by air, sea or rail, or hotel accommodation, any compensation payable will be further limited by the EU Charter of Passengers Rights for air travel, the Warsaw Convention as amended, by the Athens Convention 1974 (sea), the Berne Convention 1961 (rail), and the Paris Convention 1962 (hotel accommodation), or any such statute or regulation as may from time to time amend or supersede any of the above. Copies of the conditions of carriage and any conventions that may apply are available on request. Any independent arrangements that you make that are not part of the holiday are entirely at your own risk. 5) FORCE MAJEURE Force Majeure means (without restriction) any event which Peregrine could not, even with all due care, foresee or avoid. Force Majeure covers events such as, but not limited to, war or threat of war, riot, civil strife, terrorist activity, industrial dispute, disease, industrial or nuclear disaster, adverse weather conditions, fire and all similar events beyond our control. In the case of Force Majeure Peregrine will not accept liability, and reserves the right to change and cancel trips. 6) CANCELLATION BY YOU If you cancel your booking, land and air cancellation fees apply. Notification of cancellation must be made to Peregrine by letter or email. The date when written confirmation of cancellation is received by Peregrine will determine the charges applicable. In addition, Peregrine cancellation charges may apply. Depending on your reason for cancellation, these charges may be recoverable under your insurance policy. No refunds will be made if you leave a trip for any reason after the trip has begun. If you wish to change your booking in any way, the following fees will apply: a) Transfer from one tour to another Amendment request received by Peregrine 56 days (90 days for Antarctica and the High Arctic) or more prior to the original tour departure date: £50 per person per trip will be levied and must be paid prior to any transfer being confirmed. This does not apply when transferring from an Antarctica or High Arctic voyage to any other tour or destination (that is not an Antarctica or High Arctic voyage). In such case; a request to transfer is considered a cancellation, and normal cancellation fees as per above. Amendment requests received by Peregrine within 56 days (90 days for Antarctica and the High Arctic) prior to the original tour departure date: charges will apply as per cancellation fees. b) Amendments to your booking, in relation to any other arrangements made in conjunction with your tour (e.g. pre- and post tour accommodation, transfers, etc), received by Peregrine within 56 days (90 days for Antarctica and the High Arctic) prior to tour departure date will be subject to a £25 administration fee per change. This fee is in addition to any charges levied by ground operators, hotels or airlines. c) If you are prevented from travelling on the tour you may transfer your booking to another person provided they meet all the requirements relating to that holiday. A transfer from one person to another is dependent on the availability of tickets; permits and other travel arrangement, as some of these are regulated by local law and are not transferable from one person to another. A transfer fee of £100 is payable, and additional costs such as airline tickets and permit fees may also be payable. For bookings made within 15 days prior to departure, Peregrine reserves the right to charge a late booking fee of £25 per booking. On some trips it is not possible for us to accept late bookings as they are subject to availability. If you have taken the option to purchase carbon credits to offset your Peregrine adventure, and you for any reason decide to cancel your trip before the departure date, we will refund you the full carbon offset amount. If you cancel your trip at any time after tour departure the offset amount is non-refundable. 7) CANCELLATION BY PEREGRINE Peregrine trips are subject to minimum numbers of people on scheduled group departures. On the rare occasions when less than the minimum number have booked Peregrine reserves the right to cancel the departure and will advise you of such cancellations within 56 days (90 days for Antarctica and the High Arctic) before the tour departure date. If due to Force Majeure or government travel advice, Peregrine reserves the right to cancel a departure at any time. If we cancel your booking, Peregrine will offer you alternative arrangements, and if the price of your alternative booking is of lower repatriation and Air Ambulance charges). Personal Accident up to £25,000 Loss of an eye or limb, or permanent total disablement. Death £10,000 Cancellation or Curtailment up to invoiced holiday cost: maximum £5000 Irrecoverable charges incurred due to illness, accident to your-self or close relative, witness service, jury service, redundancy or other specific reasons. Hospital Benefit up to £200 Compensation of £10 for each day spent in hospital for incidental expenses such as phone calls, taxis, etc. Baggage and Personal Effects up to a total of £2,000 Personal effects lost, stolen or damaged. Limit for any one item or set £250 Total valuables £350 Personal Money up to £500 Lost or stolen cash, bank or currency notes, travellers cheques. Personal Liability up to £2,000,000 In respect of legal liability for accidental injury to a third party or accidental damage to their property. Delayed Departure Benefit If the departure of the aircraft, train or sea vessel of any part of the journey is delayed for at least 12 hours: up to £100 If whole itinerary cancelled after 12 hours: up to £1,000 value than the original booking we will refund the difference to you. If you do not accept alternative arrangements we will refund all payments you have made to Peregrine, (in case of Force Majeure or government travel advice refunds will be less any unrecoverable costs). Peregrine will not be liable for any delay in, change to or cancellation of trips due to Force Majeure. 8) CHANGES TO YOUR HOLIDAY Peregrine runs trips in regions where conditions can change quickly. The trips are organised many months in advance and it may become necessary to make alterations at short notice. The information about trips given in this brochure is subject to change. Where practical, any changes will be reflected in the Trip Notes that are sent to you with your Final Documentation. It is your responsibility to review the up-to-date Trip Notes sent to you with Final Documentation. If you make a booking less than 56 days (90 days for Antarctica & the High Arctic) before departure you must ensure you are fully aware of the contents of the Trip Notes. The information and conditions in the Trip Notes will be deemed to be part of the contract. Where changes to your trip occur after you have received your Final Documentation we will, where practical, advise you or your travel agent of such changes. You should remain in contact with your travel agent during the time before your Peregrine trip commences. Your trip may be varied at short notice, even after its commencement. Changes may occur because of Force Majeure, poor road conditions, weather, the availability of tickets, vehicle breakdowns, changes in transport schedules, or other circumstances beyond Peregrine control. Peregrine does not accept any responsibility for loss of enjoyment, delays or compensation resulting from changes due to Force Majeure or any reasons beyond Peregrine control. Group sizes may also vary. No refunds will be made in any of these situations. Due to the nature of these expeditions, weather, ice or government regulations may require changes to be made to your itinerary and/or the cancellation of some shore excursions. Every attempt will be made to adhere to the itineraries described within the limits of safety and time. In the event of changes, participants have no right to any refund or other compensation. Expedition prices are based on group participation. Should you choose not to take part in any activity or make use of any service provided, no refund will be made. Should the advertised tour leader or lecturer be unable to lead the tour due to illness or other reasons, a substitute person shall be found and no refund shall be made as a result of this change. Quark Expeditions reserves the right to substitute the advertised vessel at any time with any other expedition vessel of appropriate standard. 9) PRICE CHANGES Before booking and not less than 30 days prior to departure (or for whatever period may from time to time be dictated by the Government) the prices featured in this brochure may change. Peregrine reserves the right to impose surcharges once you have booked but no surcharges will be imposed within 30 days of departure (or within whatever period the Government may from time to time deem) and any downward revision in the price will be refunded to you. Surcharges will only be imposed for variations in: a) transport costs, including the cost of fuel; b) dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports; or c) the exchange rates applied to the booking. Price increases and surcharges will be calculated according to the full extra cost compared to the costs and exchange rates, which were obtained from Oanda Corporation at 18 June 2007. In any event Peregrine shall absorb the first 2% of any such surcharge (or whatever percentage the Government may from time to time dictate). In the unlikely event there is a price increase of more than 10%, you may cancel and receive a full refund of money paid. 10) COMPLAINTS If you have any complaint about your trip, you must make it known at the earliest opportunity to the leader and/or Peregrine local representative, who will normally be able to take appropriate action. If at the end of the trip you feel your complaint has not been properly dealt with you must notify us in writing within 35 days of the end of your trip. 11) AUTHORITY OF THE LEADER At all times the decision of Peregrine leader, Expedition leader or representative will be final on all matters likely to affect the safety and well-being of the trip. You must, at all times, strictly comply with the laws, customs, foreign exchange and drug regulations of all countries visited. Should you fail to comply with the above, or should you interfere with the well-being of the group then the leader or company representative may order you to leave the trip immediately with no right of refund. 12) TRAVEL INSURANCE Adequate and valid travel insurance is compulsory for all Peregrine travellers and it is a condition of Peregrine accepting your booking that you will have obtained adequate and valid travel insurance for your booking by the date of departure. Your travel insurance must cover accidents, injury, illness and death medical expenses, including any related to pre-existing medical conditions, emergency repatriation (including helicopter rescue and air ambulance where applicable) and personal liability. Peregrine also recommends it covers cancellation, curtailment and loss of luggage and personal effects. You must carry proof of insurance with you and produce it if reasonably requested by Peregrine employees or suppliers. Once your trip has commenced, if you are unable to provide proof of insurance this will render the contract void and Peregrine may terminate or suspend your participation on a trip or in certain activities that comprise part of a trip, at any time with no right of refund. 13) PRE-EXISTING MEDICAL CONDITIONS Before making a booking, you must advise Peregrine of any preexisting medical condition and/or disability that might reasonably be expected to increase the risk of you requiring medical attention, or that might affect the normal conduct of a trip and the enjoyment of other trip members. You are required to provide an assessment of your medical condition from a qualified medical practitioner. If you fail to adequately notify Peregrine of any pre-existing medical Legal Expenses up to £15,000 To pursue a claim against a third party following injury or death during the period of travel. Expenses due to government travel restrictions: Cancellation or curtailment: up to £750 Additional costs: £300 Medical Exclusions Cover is excluded for any pre existing medical condition. If in doubt call our medical helpline, in confidence, on 01932 334 198. It is a condition of our insurance that your trip is not booked or commenced: a. contrary to medical advice or to obtain medical treatment. b. if you are suffering from any medical condition or symptoms which are awaiting or receiving investigation, treatment, tests referral or review or the results of any of these. c. if you are aware of any reason why your travel may be cancelled or curtailed. Note: The above is a summary only of the cover available; specific details are contained in the leaflet, which you will receive on booking, or in the Master Policy which is available for inspection at our brokers offices. PREMIUMS Europe & Canadian Arctic Rest of world Scandinavian Arctic 9 days £69 9 days £58 9 days £21 17 days £76 17 days £66 17 days £27 24 days £84 24 days £72 24 days £37 32 days £91 32 days £79 32 days £46 45 days £129 45 days £110 45 day £70 condition or disability, Peregrine reserves the right to cancel your participation in a trip at any time, including after the commencement of your trip, with no right of refund if your medical condition and/or disability could be reasonably expected to affect the normal conduct of the trip and the enjoyment of other trip members. 14) AGE LIMITS Generally, we do not allow travellers under the age of 18 years on Peregrines scheduled itineraries. However we will occasionally make exceptions for under-18s travelling with their legal guardian. The decision for any person under 18 years of age to travel on our scheduled itineraries is at the absolute discretion of the management of Peregrine. For further information please contact Peregrine Adventures. 15) DATA PROTECTION To ensure that your holiday runs smoothly, we (and your travel agent, if you use one) need to use information such as your name and address, special needs, dietary requirements, etc. We will apply appropriate security measures to protect this data. However, we must pass it to suppliers of your travel arrangements, including airlines, hotels and transport companies. We may also supply it to security or credit checking companies, and to public authorities such as customs and immigration. If your holiday is outside the European Economic Area (EEA), controls on data protection in your destination may not be as strict as in the UK. We will only pass data, including sensitive information regarding disabilities or dietary and religious requirements, to people responsible for your travel arrangements. If we cannot pass this information to the relevant suppliers, in the EEA or elsewhere, we cannot provide your booking. When you make this booking, you consent to this information being passed to the relevant people. Information held by a travel agent is subject to that companys own data protection policy. We can supply a copy of your information held by us; there is a small charge for providing this. 16) WAIVING OF BOOKING CONDITIONS The Booking Conditions may only be waived or amended by written mutual consent signed by a Director. When you complete the Booking Form you agree to accept all these conditions, and when we accept your booking we agree to carry out our obligations to you as defined in this brochure and other information provided to you. 17) BROCHURE This brochure was printed in October 2007. Prices have been calculated in accordance with foreign currency exchange rates. 18) YOUR FINANCIAL SECURITY Any holiday in this brochure sold with international flights is ATOL Protected, since we hold an Air Travel Organisers Licence granted by the Civil Aviation Authority. Our ATOL number is ATOL 6076. In the unlikely event of our insolvency, the CAA will ensure that you are not stranded abroad and will arrange to refund the flight costs you have paid to us for an advance booking. For further information, visit the ATOL website at www.atol.org.uk. Please note that ATOL bonding only applies to bookings made in the UK that include international flights from the UK. All land-only holidays advertised in this brochure are financially protected through the Companys membership of the Federation of Tour Operators (FTO). For all such holidays this means the FTO will arrange for any monies you have paid to the Company for an advance booking to be refunded or for you to be repatriated if already abroad in the event of your confirmed holiday arrangements not being provided due to the Companys insolvency. CONDITIONS 19 & 20 ARE ADDITIONAL AND REFER ONLY TO ANTARCTICA AND HIGH ARCTIC EXPEDITION BOOKINGS 19) PASSAGE TERMS Please note that the acceptance of bookings and the carriage of passengers is strictly in accordance with the terms and conditions of the Supernova Expeditions Cruise Contract or the Peregrine Shipping Passage Ticket, the terms of which are incorporated into and form part of these booking conditions. A copy of Supernova Expeditions Cruise Contract or Peregrine Shipping Passage Ticket will be provided on request. Your Cruise Contract detailing these terms and conditions will be issued with your booking confirmation, and must be signed and returned to us within 90 days before departure. You should note that the terms and conditions of Supernova Expeditions Cruise Contract or Peregrine Shipping Passage Ticket may either excuse Supernova Expeditions or Peregrine Shipping from liability for damages arising from illness, personal injury or death or damage to or loss of property or may limit such liability. Peregrine will not issue your Supernova Expeditions Cruise Contract or the Peregrine Shipping Passage Ticket unless you have established to Peregrine that you have obtained appropriate travel insurance. 20) RESPONSIBILITY In accordance with Supernova Expeditions Cruise Contract or the Peregrine Shipping Passage Ticket, Quark Expedition or Peregrine shall not be responsible for any damages, including damages resulting from illness, personal injury, death, damage to or loss of property, which may be sustained by reason of, or while engaged on, any expedition whether due to the ownership, maintenance, use, operation or control of any aircraft, helicopter, automobile, boat, vehicle, hotel, common carrier or any other conveyance used in carrying out these expeditions. Quark Expedition and Peregrine will not assume liability due to any cause whatsoever whether caused by failure or delay or other irregularity, acts or omissions occurring during an expedition under which the means of transportation or other service provided is thereby offered or supplied by owners, operators or public carriers where Quark Expedition or Peregrine acts only as an agent. On acceptance of your booking each participant shall be deemed to agree to the above exclusion for damages and to acknowledge the potential hazards of an expedition. 21) GOVERNING LAW This agreement will be governed by and construed in accordance with English law and each party agrees to submit to the jurisdiction of the English courts as regards any claim or matter arising under this agreement. If, however, you booked your holiday in Scotland or Northern Ireland any disputes may be dealt with in the local courts in Scotland or Northern Ireland and will be subject to the law of those countries. Insurance premiums double for persons aged 66 upwards. ANNUAL MULTI TRIP INSURANCE Up to ten weeks for any single journey. Any number of trips in a 12 month period. Spouse covered if travelling independently. No advance notice of travel required. Cover is automatic for any trip. Individual insurance from £115.00 Annual insurance premiums double for persons aged 66 upwards and cover is not available for persons aged over 75 years. The above premiums include UK Insurance Premium Tax at a rate of 17.5%. For certain technical reasons some trips have slightly higher premiums. Please see individual trips for details. Please note that insurance premiums are not refundable except in the circumstances described in our Booking Conditions. Any amendments to your Travel Insurance made more than 14 days after the certificate has been issued will incur a £10 administration fee, plus or minus the appropriate premium adjustment. 146 // Peregrine
