economic needs, within 15 days from the identification of the person entitled to compensation. In the event of death, this advance payment shall not be less than approximately £13,000. Passenger Delays In case of passenger delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for passenger delay is limited to approximately £3,300. Baggage Delays In case of baggage delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for baggage delay is limited to approximately £800. Destruction, Loss Or Damage To Baggage The air carrier is liable for destruction, loss or damage to baggage up to approximately £800. In the case of checked baggage, it's liable even if not at fault, unless the baggage was defective. In the case of unchecked baggage, the carrier is liable only if at fault. Higher Limits For Baggage A passenger can benefit from a higher liability limit by making a special declaration at the latest at check-in and by paying a supplementary fee. Complaints On Baggage If the baggage is damaged, delayed, lost or destroyed, the passenger must write and complain to the air carrier as soon as possible. In the case of damage to checked baggage, the passenger must write and complain within 7 days, and in the case of delay within 21 days, in both cases from the date on which the baggage was placed at the passenger's disposal. Liability Of Contracting And Actual Carriers If the air carrier performing the flight is not the same as the contracting air carrier, the passenger has the right to address a complaint or to make a claim for damages against either. If the name or code of an air carrier is indicated on the ticket, that air carrier is the contracting air carrier. Time Limit For Action Any action in court to claim damages must be brought within 2 years from the date of arrival of the aircraft, or from the date on which the aircraft ought to have arrived. Basis For The Information The basis for the rules described above is the Montreal Convention of 28 May 1999, which is implemented in the Community by Regulation (EC) No. 2027/97 (as amended by Regulation (EC) No. 889/2002) and national legislation of the Member States. Athens Convention Your cruise is subject to the terms and provisions of the Athens Convention relating to the Carriage of Passengers and their Luggage by Sea 1974 ("the Athens Convention") and the London Convention of Limitation on Liability for Maritime Claims 1976 ("the London Convention"). The Athens Convention is expressly incorporated into these Conditions and any liability we may have for death or personal injury or for loss of or damage to luggage arising out of carriage by sea shall be determined accordingly. In most cases, the Athens Convention limits the carrier's liability for death or personal injury, or loss of or damage to luggage and makes special provision for valuables. It presumes that luggage has been delivered undamaged to the passenger unless written notice is given to us (as carrier) either (i) in the case of obvious damage, before or at the time of leaving the ship or when the luggage is returned to the passenger, and (ii) in the case of damage which is not obvious or if the luggage, or part of it, is lost, within 15 days from the date of leaving the ship or from when the luggage was or should have been returned to the passenger. Any damages payable by us and/or the ship owner up to the limits provided by the Athens Convention shall be reduced by the maximum deductible specified in Article 8.4 of that Convention. In no circumstances shall we or the ship owner be liable in respect of consequential loss and damage, detention, delay or overcarriage, howsoever caused. Insofar as the cruise may be performed on a ship not owned by us, it is agreed that we shall at all times nevertheless be deemed a ship owner for the purposes of the London Convention, whether as amended or otherwise and as in force in any relevant jurisdiction from time to time, and so entitled to limit liability there under. Cots There's usually room for one cot in all our villas, but you'll need to check with us before you travel to make sure there will definitely be one available when you arrive. In some countries, such as Italy, you'll need to pay a daily charge to hire a cot. If you decide to bring your own travel cot, bear in mind there's no extra luggage allowance for these and the airline will charge extra if you go over your limit. Crèches These are available at some properties. Bear in mind, if your child's ill they won't be accepted. Also, you'll need to supply your own nappies, prepared feeds and packed lunches. We can't guarantee standards at crèches that aren't run by us. Customer Welfare See Special Assistance. Our Use of Your Information (1) For the purpose of providing you with our services, including your flight, holiday or insurance, etc., we may disclose and process your information outside the UK/EEA. In order for you to travel abroad, it may be mandatory (as required by government authorities at the point(s) of departure and/or destination) to disclose and process your information for immigration, border control, security and anti-terrorism purposes, or any other purposes which they determine appropriate. These requirements may differ depending on your destination and you are advised to check. Even if not mandatory, we may exercise our discretion to assist where appropriate. (2) We may collect and process your information for the purposes set out in our registration with the Office of the Information Commissioner, and disclose the same to our group companies for business purposes and also to companies and our service providers who act as "data processors" on our behalf, or to credit and fraud agencies (some of whom are located outside the UK/EEA). These business purposes include administration, providing services (and contacting you where necessary), customer care, service quality, business management and operation, re-organisation/structuring/sale of our business (or group companies), risk assessment, security, fraud and crime prevention/detection, monitoring, research and analysis, marketing, customer purchasing preferences and trends, dispute resolution, credit checking and debt collection. (3) Information (such as health or religion) may be considered "sensitive personal data" under the Data Protection Act 1998. We collect it to cater to your needs or act in your interest, and we are only prepared to accept sensitive personal data on the condition that we have your positive consent. By booking with us you also agree for your insurers, their agents and medical staff to disclose relevant information and sensitive personal data to us in circumstances where we need to act on your behalf or in the interest of passengers or in an emergency. If you do not agree to Our Use of Your Information above, we cannot do business with you or accept your booking. Direct Marketing Material (1) We may from time to time contact you with information on offers of goods and services, brochures, new products, forthcoming events or competitions from our holiday divisions and our group companies. Our websites will assume you to agree to e-communications when you make a booking. (2) You may indicate your preference regarding receiving third party direct marketing material. (3) If do not wish to receive such information or would like to change your preference, please refer to point (2) of "Your Rights" below. Your Rights (1) On completing our Data Subject Access Request form, you are entitled to a copy of the information we hold about you (for a £10 fee) and to correct any inaccuracies. (2) You have the right to ask in writing not to receive direct marketing material from us. If available, you can amend your previous preference on our website(s), use our "unsubscribe email" or refer to our literature containing instructions. Once properly notified by you, we will take steps to stop using your information in this way. (3) For a list of our group companies or brands, please send us your request. US Secure Flight Data: The Transportation Security Administration (TSA) requires you to provide your full name, date of birth ,and gender for the purpose of watch list screening, under the authority of 49 U.S.C. section 114, the Intelligence Reform and Terrorism Prevention Act of 2004 and 49 C.F.R parts 1540 and 1560. You may also provide your Redress Number, if available. Failure to provide your full name, date of birth, and gender may result in denial of transport or denial of authority to enter the boarding area. TSA may share information you provide with law enforcement or intelligence agencies or others under its published system of records notice. Day-before Check-in At Gatwick, Manchester and Birmingham, you can check in at the airport from 12pm to10pm the day before you travel, subject to availability. All members of your group need to check-in together. This is to meet the Department For Transport's security requirements. You'll need everyone's tickets, passports and luggage. Day-before Check-in is free if you're flying with Thomson Airways from Gatwick and Manchester and you don't need to book. At Birmingham, you'll need to book this service and there may be a charge. If you're travelling to a destination that has additional security at check-in, we won't be able to issue your boarding cards. At the moment, this includes flights to the United States. You can still check in your luggage but you'll need to return to check-in the following morning to pick up your boarding cards. Delays Depending on airport facilities, we provide light refreshments for a delay of 2 to 4 hours, a meal - or vouchers for a meal - for 4 to 8 hours, overnight accommodation for delays of 8 to 12 hours if it's necessary and possible. If a delay is longer than 5 hours, you can cancel your flight and we'll refund the flight part of your holiday. We'll only refund the whole cost of your holiday if we change or cancel your holiday. Deposits As well as the deposit you pay when you book, you may also be asked to pay a deposit in local currency when you arrive. Deposits cover all, or part of, the replacement costs for things being lost, broken or damaged. It's also to take care of any unusual cleaning charges. You'll get it back when you leave, or with an amount deducted if necessary. The property needs to be inspected before you leave. In some cases, your deposit will be returned to you by post. Unfortunately we can't accept responsibility for any disputes which may arise, although we'll try to help you to resolve them. Data Protection When we talk about data protection, we're actually referring to TUI UK Limited's privacy policy. It sets out what information we collect about you, how we collect it, and what we do with it. The following is a UK group-wide policy so we need to include it in full here... Your Information This refers to a combination of information such as your name, contact details, travel preferences and special needs/disabilities/dietary requirements that you supply us or is supplied to us, including any information about other persons on your booking ("your information"). Your information is collected when you request information from us, contact us (and vice versa) or make a booking. You are responsible for ensuring that other members of your party are aware of the content of our Privacy Policy and consent to your acting on their behalf in all your dealings with us. We will update your information whenever we can to keep it current, accurate and complete.

Early Check-in See Day-before Check-in. Extra Charges The key aspects of your holiday will be included in the price when you book - see Prices for details. But it's important to point out you may have to pay extra for some things when you get there. For example, you might want to book an excursion or use a safety deposit box.
